Less than a month after the Supreme Court denied the Trump administration’s attempt to end the DACA program, a federal judge has secured another victory for young immigrants and immigration advocates. Earlier this month, Judge Paul Grimm of the US District Court for the District of Maryland ruled that the DACA program must be restored to its “pre-September 5, 2017 status.”
In other words, the judge ruled that the Trump administration must begin processing new DACA applications.
Immigration activists see this victory as an extension of the Supreme Court ruling, making it clearer how USCIS should start implementing the DACA ruling into policy. The years-long legal battle over the fate of DACA kept newly eligible applicants from receiving protections and benefits, but now those applicants can begin the process.
DACA eligibility means you:
- Arrived in the US before age 16
- Have been here since June 15, 2007
- Were younger than 30 in 2012
While the program offers no pathway to citizenship, it does provide young immigrants with work authorization and protection from deportation. Both of those benefits are extremely vital for immigrant families, mentally and financially.
