On January 10, 2025, USCIS announced an automatic extension of Temporary Protected Status (TPS) for nationals of certain countries. The details are as follows:
- Ukraine: TPS extended from April 20, 2025, through October 19, 2026.
- Venezuela: TPS extended from April 3, 2025, through October 2, 2026.
- El Salvador: TPS extended from March 10, 2025, through September 9, 2026.
- Sudan: TPS extended from April 20, 2025, through October 19, 2026
If you currently hold TPS status, your work permit will be automatically extended without any action required from you:
- Ukraine: Automatically extended until April 19, 2026.
- Venezuela: Automatically extended until April 2, 2026.
- El Salvador: Automatically extended until March 9, 2026.
- Sudan: Automatically extended until April 19, 2026
However, to maintain your TPS status beyond these automatic extension dates, you must formally re-register. When re-registering, you have the option to apply for a new work permit, which will be valid for 540 days from the expiration date of your current work permit, potentially granting you more time in TPS status.
To determine if applying for a new work permit is beneficial, you can use the USCIS EAD Automatic Extension Eligibility Calculator by entering your current permit’s expiration date. Nonetheless, we recommend obtaining a new work permit card.
Please note:
- If you have not received your work permit from a prior renewal and have a receipt dated May 4, 2022, or later, you automatically qualify for the 540-day extension. Your new card will reflect this date upon delivery. However, you must still re-register.
- Failing to re-register during the designated period may result in losing your status after the automatic extension ends. You might be unable to reapply in the future and could face deportation or removal from the U.S. under President Trump’s latest deportation actions.
We strongly urge you to re-register as soon as possible. The re-registration period for El Salvador, Ukraine and Sudan runs from January 17, 2025 through March 18, 2025. Venezuela re-registration is from January 17, 2025 through September 10, 2025 (new applications fort Venezuela can also be filed during this period). The government does not charge a fee to file the application, except for a $30 biometric fee required from all applicants. The paper filing fee for the new work permit is $520, and we will need two passport-style photos to accompany the application.
Unfortunately, we cannot predict whether TPS will be extended beyond the specified dates. If you have any questions regarding the above information or would like to review your immigration status, please contact our office.
